These Terms of Service (“Terms”, “Agreement”) govern all building, carpentry, renovation, and related services provided by RM Building Dynamics (“we”, “our”, “us”) to clients (“you”, “your”) in New South Wales, Australia.
By engaging our services, requesting a quote, paying a deposit, or approving a proposal, you agree to these Terms.
1. Scope of Work
- All work will be carried out according to the approved quote, project specification, drawings, or written communication.
- Any change to the agreed scope must be approved via written confirmation and may result in additional charges.
2. Quotes & Pricing
- All quotes are valid for 30 days unless stated otherwise.
- Quotes are based on the information provided by the client. If site conditions differ, pricing may change.
- Any additional work not included in the original scope will be quoted separately and must be approved before proceeding.
3. Deposits & Payments
- A deposit is required before work is scheduled.
- Progress payments follow the payment schedule provided in the quote or invoice.
- All invoices must be paid by the due date.
- Work may be paused if payments are not made on time.
4. Variations (Changes to Work)
Variations include:
- Changes requested by the client,
- Unforeseen conditions (e.g., structural issues, water damage),
- Material upgrades or replacements.
All variations will be priced separately and must be approved in writing.
5. Materials & Products
- Materials sourced specifically for your project are non-refundable once purchased.
- If products are unavailable, we may offer equivalent alternatives with client approval.
- Supplier warranty conditions apply to all materials.
6. Workmanship & Warranty
RM Building Dynamics provides:
- Warranty under NSW Home Building Act 1989,
- Guarantees under Australian Consumer Law,
- Manufacturer warranties for products/materials used.
Warranty does NOT cover:
- Misuse,
- Lack of maintenance,
- Damage caused by external factors (water leaks, weather, occupants, third-party trades).
7. Access to Property
The client must provide:
- Reasonable access to the site,
- Water & electricity if required,
- Safe working conditions.
Extra charges may apply if access is restricted or delayed.
8. Client Responsibilities
You agree to:
- Ensure the site is safe and ready for work,
- Notify us of any hazards (asbestos, wiring issues, structural risks),
- Provide timely decisions and approvals during the project.
9. Delays
We are not responsible for delays caused by:
- Weather,
- Supplier shortages,
- Council approvals,
- Third-party contractors,
- Client-driven changes.
10. Refunds & Cancellations
- Deposits are non-refundable once materials are ordered or scheduling has started.
- If cancellation occurs after work has started, the client must pay for:
- Labour completed,
- Materials purchased,
- Costs incurred up to the cancellation date.

11. Liability
RM Building Dynamics is not liable for:
- Pre-existing defects,
- Damages caused by other trades,
- Client-supplied materials,
- Improper use or lack of maintenance by the client.
12. Photos & Marketing
You give permission for RM Building Dynamics to take before/after project photos for marketing purposes unless you request otherwise in writing.
13. Privacy
Your personal information is handled in accordance with our Privacy Policy.
